These Terms of Use (hereafter referred to as “Terms”) govern your use of any Mobile App, In-App purchase (IAP), website, or other software, product, or service provided, owned or operated by Artisan Coffee Group, Inc (hereafter collectively referred to as “Services” unless otherwise delineated).
These Terms were last modified on January 29, 2022. Artisan Coffee Group, Inc. may, at is sole discretion, change, modify, add or remove aspects of these terms without notice. Your continued use of Services provided by Artisan Coffee Group, Inc. will serve as your acceptance of any future changes to these Terms.
Acceptance
By installing, using or accessing Artisan Coffee Group, Inc. Services, you agree to be bound by these Terms. If you are not in agreement with the conditions of these Terms, please refrain from installing, using or accessing Services provided by Artisan Coffee Group, Inc.
The content and functionality contained in Artisan Coffee Group, Inc Services. is provided on an “as is” basis. Artisan Coffee Group, Inc. will not be held liable to any party for damages of any kind–including, but not limited to, direct, indirect, special, incidental or other consequential damages–resulting from the use of our Services.
You may not use any of the Services provided by Artisan Coffee Group, Inc. for any unlawful purpose, or related to any activity (legal or otherwise) that infringes on the rights of Artisan Coffee Group, Inc. or other parties.
All hardware and services needed to run OpenCup is the sole responsibility of the end user, including iOS devices & their accessories, internet service providers & their equipment, data backup services and company network services & equipment.
1. OpenCup LICENSE GRANT; RESTRICTIONS OF USE
Subject to these Terms of Use, Artisan Coffee Group, Inc hereby grants to you a limited, non-exclusive, non-transferable license, without the right to grant sublicenses, to access and use OpenCup; provided, however, that you may only use OpenCup in connection with Artisan Coffee Group, Inc products purchased and used pursuant to the Artisan Coffee Group, Inc terms and conditions associated with such products.
Furthermore, if you have accessed or used OpenCup through an application downloaded from the Apple, Inc. (“Apple”) application store (such app, the “Apple App”), you will use the Apple App only: (i) on an Apple-branded product that runs iOS (Apple’s proprietary operating system software); (ii) on only the iOS devices this Apple App is designed for; and (iii) as permitted by the “Usage Rules” set forth in the Apple App Store Terms of Service with specific reference to:
(iii) If you are a commercial enterprise or educational institution, you may download and sync an App Store Product for use by either (a) a single individual on one or more iOS Devices used by that individual that you own or control or (b) multiple individuals, on a single shared iOS Device you own or control. For example, a single employee may use an App Store Product on both the employee's iPhone and iPad, or multiple students may serially use an App Store Product on a single iPad located at a resource center or library. For the sake of clarity, each iOS Device used serially by multiple users requires a separate license.
You will not: (i) reverse engineer, decompile, disassemble, or otherwise attempt to discern the source code or interface protocols of the Platform; (ii) modify, adapt, or translate OpenCup; (iii) make any copies of the Content (as defined below) or any components of OpenCup; (iv) make OpenCup available on a “service bureau” basis; (v) remove or modify any proprietary marking or restrictive legends placed on OpenCup; (vi) use OpenCup in violation of any applicable laws or for any purpose not specifically permitted in these Terms of Use; or (vii) introduce into OpenCup any software, virus, worm, “back door,” Trojan Horse, or similar harmful code. You may not access OpenCup for purposes of monitoring performance or functionality, or for any other benchmarking or competitive purposes.
2. Accessing and Downloading OpenCup from Apple App Store
The following terms apply to any Apple App. These terms are in addition to all other terms contained in these Terms of Use:
Intellectual Property Rights
All content contained in our Services is protected by copyright and intellectual property laws, and may be further protected by other restrictions. Any content provided by Artisan Coffee Group, Inc. Services may not be duplicated, adapted, sold or otherwise used for any commercial purpose without our prior written consent.
Privacy
OpenCup iOS and InApp Purchase Privacy
Personal Information: OpenCup DOES NOT collect, store, distribute or otherwise use ANY personal data such as name, street address, phone number, credit card numbers, social media usernames or passwords, friend information, birthdays, likes, interests or associations.
Social Media: You may voluntarily choose to let OpenCup post on your behalf to popular social media sites, such as Facebook and Twitter. OpenCup accesses necessary personal social media information for the SOLE purpose of posting on your behalf, and is mediated by iOS restrictions. OpenCup DOES NOT process, evaluate, store or retain this information in any way.
Website Privacy
Personal Information: Our website, www.opencup.coffee, collects and stores personal information, relative ONLY to the creation of user accounts for participating in our online blog and/or forum (IF ACTIVE). This information is securely stored, and not sold, shared or otherwise distributed to third parties. It is used only by Artisan Coffee Group, Inc. to allow continued, secure participation in these services. We may access this information to contact you directly, pursuant to queries to us, or to inform you of future products, services or enhancements. Analytic Data: In an effort to help us improve our Services, we may use analytical tools to view NON-PERSONAL information when accessing or using our website. 2. Accessing and Downloading OpenCup from Apple App Store
The following terms apply to any Apple App. These terms are in addition to all other terms contained in these Terms of Use:
- You acknowledge and agree that (i) these Terms of Use are concluded between you and Artisan Coffee Group, Inc only, and not Apple, and (ii) Artisan Coffee Group, Inc, not Apple, is solely responsible for the Apple App and content thereof. Your use of the Apple App must comply with the App Store Terms of Service.
- You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Apple App.
- In the event of any failure of the Apple App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Apple App to you and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Apple App.
- You acknowledge that, as between Artisan Coffee Group, Inc and Apple, Apple is not responsible for addressing any claims you have or any claims of any third party relating to the Apple App or your possession and use of the Apple App, including, but not limited to: (i) product liability claims; (ii) any claim that the Apple App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- You acknowledge that, in the event of any third party claim that the Apple App or your possession and use of that Apple App infringes that third party’s intellectual property rights, as between Artisan Coffee Group, Inc and Apple, Artisan Coffee Group, Inc, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms of Use.
- You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of these Terms of Use as related to your license of the Apple App, and that, upon your acceptance of the terms and conditions of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use as related to your license of the Apple App against you as a third party beneficiary thereof.
- Without limiting any other terms of these Terms of Use, you must comply with all applicable third party terms of agreement when using the Apple App.
Intellectual Property Rights
